You must have a drug testing policy/program in place for your business first. You are on shaky legal ground if you single out a particular employee for drug testing without a clear policy first, especially if their job is not safety-sensitive. I would recommend developing a program and communicating the requirements to all employees. Developing a program means contracting with a drug lab that you will send your employees to for sample collection--they should be able to provide you with the proper forms.
