Power of attorney requires a minimum of a 4th grade education. Although if you reside within the southern states, a high school diploma is equivalent. If you lack the education credentials, there is usually a guy behind Blockbuster that can do it for you. He can also buy you beer if you are under 21, or perform the duties of a notary.

Why is the phrase attorney at law used?

An attorney-at-law is a person with a law degree that represents people in legal matters. There is another kind of attorney, though. An attorney-in-fact is someone who is granted power of attorney with respect to another person's affairs. An attorney-in-fact is not necessarily a lawyer, just a person who is empowered to make decisions for someone else.

Can your attorney in fact under your power of attorney keep you from returning home even if your doctor says it is okay?

No. A POA gives no such power over your person or affairs to the attorney in fact. The AIF can only act upon your request and for your convenience. If you are still of sound mind, you can simple revoke your Power of Attorney at any time and without delays. Even without revoking the power of attorney, you still have the right to make decisions in your own behalf. Read the Power you signed. If it was done properly, all of this is clearly stated. For someone to have that kind of authority over you they would need to be appointed your guardian by a court of law.

It only covers the areas specified while you are alive. As long as you are mentally competent you can revoke the Power of Attorney, select a different Agent or just terminate or revoke it.A Court may invalidate the Power of Attorney if it is determined that you were not mentally competent when you signed it or if you were a victim of some kind of fraud. If your Agent is your spouse, in some states the Power of Attorney is terminated automatically upon divorce. If an Agent is not available, your Power of Attorney may be terminated.
