The penalties would usually be spelled out in an employment contract. Industrial espionage could also constitute theft in some rare cases. Generally though, this is a civil matter and if caught, you will be held financially responsible for the any losses you have caused. In addition, the company that you work for that is sanctioning the espionage could be punished financially.

If there is nothing in an employment contract that says that you can not work for a competitor at the same time and there is no non-compete clause for the length of time that you can not compete when you move from one company to another it would be difficult to enforce any issues regarding espionage.

Do keep in mind however that some things are protected under law such as patent and trademark secrets and this could significantly change the out come of an industrial espionage case.
