first of all you may want to contact the police if he is here under fake information and let them know and they will take him in to custody because if he is here is in the united states and does not belong here he will eventually get caught and he can be in jail for a very long time because that is nothing to play with especiallly if he has been here for a while and there is no way to get child support out of him if he is not even a legal us citizen he needs to get his paper work legal and then that's when you can start taking your steps forward for the child support but he would have to go back to where ever he came from because he can not be here already and try to get his information to be in the united states legally because he is not here legally
AnswerHe would not have any rights in a "divorce" if you were married under the fake ssi. because that would be false pretences and your marriage basically would not have been legal to begin with. As far as child support you need to get names and addresses of everyone that he knows in the country he came from then call your local State's Attorney and ask if your state works with that country to enforce child support. If you do "divorce" him and you think that he will flee the country at the threat of child support be sure to tell that to the state. They will put a tag on his id (since you have to show it to leave the country) and they will hold him if he trys to leave the country without paying child support. I suggest you consult a lawyer and your local law enforcement before you take any steps. They will be able to help you with this.Wiki User
