Analyze your legal situation. If you don't owe the money legitimately, you may want to fight them in court. If you do owe the money you will want to be active in the legal process and either settle the matter with Capital One (they will often take a portion of what is owed in order settle the account) or present your financial picture to the court to make sure you get a fair judgment. Don't let it go and then act surprised when wage garnishement kicks in. Letting things go is generally how it gets to this point in the first place.
