Depenending on what you are asking about, there are two types: a Tribal system and the Governmental system. The Tribal system is based on Sharia and old world ways. It is mainly used by the rural areas because even though there is a governmental system in Afghanistan, there is not a lot of order. The tribal system is set so that tribal leaders or elders are the judge and jury for crimes that take place in their villages. There are not a whole lot of court houses in Afghanistan. These village elders take what they have learned from Sharia law and incorporate them into the punishment of the wrong doer. For instance, they believe that if you steal your hand should be cut off. It is the laws and regulations taken from the Quran and used.

The governmental system is really the Kabul government system. If you commit a crime in Urbanized Kabul, you will be imprisoned and seen by an appointed judge for your crimes. This goes for anyone in the government who works or otherwise has affiliation with it. For instance, Afghan soldiers fall under this system of law and jurisprudence.

The majority of the laws are created by these types of persons. If you are a poor miinority with unpopular points of view, then the criminal justice system will systematically exploit, oppress, and manipulate you. These types of persons are usually not involved in, or privy to, the creation of laws. Although the equality of the criminal justice has improved, powerful entities in society are constantly becoming better at discriminating and/or oppressing through legal means.
