Chief Justice John Marshall firmly established the Court's power of judicial review, or authority to declare a law unconstitutional, when he found Section 13 of the Judiciary Act of 1789 violated Article III of the Constitution. This was notthe first time the Supreme Court evaluated the constitutionality of a law, but was the first time the Court overturned (part of) an Act of Congress.
