This 1819 decision established two differing principles in constitutional law. McCullough v. Maryland came about when the state of Maryland attempted to impose a tax on the Second Bank of the United States. The state claimed it had the right to act as a sovereign entity based upon its ratification of the Constitution. The Supreme Court ruled, first of all, that the federal government had the right to create a bank. He further ruled against the sovereignty of the State of Maryland, saying it was the people of Maryland that ratified the Constitution not the state. He held that Maryland could not tax the bank without violating the Constitution.

McCulloch v. Maryland, 17 U.S. 316 (1819), was a landmark decision by the Supreme Court of the United States. This fundamental case established the following two principles:

  1. The Constitution grants to Congress implied powers for implementing the Constitution's express powers, in order to create a functional national government.
