The 16th Amendment, which is often used to justify direct taxation, was ratified in the year 1913.
Article 5 of the US Constitution states that amendments can be made "Provided that no amendment which may be made prior to the year 1808 shall in anyway change clauses 1 and 4 of the 9th section of the 1st article"
Where the word may means across the board that "the government can do it but doesn't have to." And where because we're in a post 1808 world, no amendment is Constitutionally allowed to change clauses 1 or 4 of article 1 section 9.
The importance of article 1 section 9 clause 4 is this; "No Capitation, or other direct, tax shall be laid, unless in proportion to the census(a capitation) or enumerated herein before directed to be taken(or other direct)"
Because of the facts enumerated above, there is not a single direct tax in America that is legal nor Constitutional. This includes the Income tax, property tax, and every other type of government mandated spending for the people.
