As a officer of the court ,I would remand the parolee back to jail for resentencing.
In Winnebago County, Illinois I was faced with the same situation. I discussed it with my probation officer before the test and found that if I had a dirty test I would have my probation violated, and that means go back to court and have probation vacated to get all the time that I was suppose to serve. But also he told me that I could admit to the dirty test and not have to take it, and three admittances means an violation worthy of getting my probation vacated. So my suggestion is to admit it and not go through testing dirty.
After. A person is not on probation until they are sentenced to probation by the Court. Why would they get a probation officer until they are sentenced?
The general answer would be, that parolees may not 'consort with' (be around) known criminals. Best thing to do would be for them to call their parole officer and simply ask.
i would like to know if a probabtion officer has a probationer falsely detained and jaile dare there consequences for the probation officer? and if not how can we report information on a probation officer legally?
It is usually the other way round as the Probation Office is supposed to keep an eye on you as you, at regular times, report to him. If you violated your probation it would be the Probation Officer who would notify the courts.
I would call your probation officer to find out.
Chances are in this case your probation officer would revoke your probation and you would have to serve time in jail.
I would ask your Probation officer this question. He would have the best answer.
You would have to write a letter to the Probation Officer's supervisor requesting a new supervising officer and setting forth what you believe the 'conflict of interest' to be.
Depending on the state it would be the chief probation officer or the judge.
Not living at the address given to your probation officer would be considered violating probation. Doing this can get you sent back to prison for the remainder of your sentence.
Hi before you go against what your probation officer says, talk to the judge first. Answer You would have to assume that the probation officer has your best interests in mind. Take the extra help and advice and you will come out better in the end.
