yes.carefully call up the original creditor(hospital, department store, credit card etc)and request that they send the original bill to you.that you do NOT recall this bill-debt.offer no further information.the "right off "starts at the first miss payment.say you paid at the hospital billing department 3 monthes in a row.and then stop.on the fourth month, that is the original default date.from the original default date to 7 years and six monthes.you will need that first notice ,lets say from the hospital when you stop payment to prove the count down.or else they will keep it on over the time of statue of limitation by reselling the debt.this is how the collection agency stay in business.by the consumer believing them and not having the proof on the first default date.file complaints to the ftc and attorney general.until our leaders take a firmer stand against these violation of the collection agency this will continue.there are lawyers out there looking for cases like yours.i would search Google,to see if your collection agency has been sued by the ftc and etc.they may be barred from collecting on certain debt, and that you can sue them for that additionally.now wouldn't it be nice to turn the table on them!!watch your write off date.it is common when a debt is two monthes from the deadline on collecting they will sell it to another collection agency.which it will be more time added.

If a debt is sold to another company for collection does it take another 7 years from the transfer of debt for it to come off your credit report in California?

The date of first delinquency should be the date that starts the clock for the 7 years. Meaning if you went 30 days late in April 2005, on a credit card, and then 60, 90 then 120, then the account would go to charge off status but the date of first delinquency would be April 2005. In CA, 4 years from the date of first delinquency is within the statute of limitations is in effect that a creditor or collection agency can sue you for the amount owed. This will vary from state to state, If the collection agency sells the collection to another collection company, the start date is the date of first delinquency, April 2005. If the collection agency changes the date, that is called re-aging and is illegal unless you set up new terms with collection agency

Do you have to pay the balance owed after self repossession?

You pay what is owed after the creditor sells the car for. So if you owed 10,000 and the creditor sells it for 8000 at an auction, then you would owe the remaining balance.

How many years does an unpaid loan last?

A unpaid loan lasts forever or until it is lost. Basically if a lender is fed up with waiting to get paid it sells the loan to a collection agency which buys it at a fraction of the value. The collection agency upon purchase of the loan then has the right to pursue the person who's name is on the loan. Collection agencies are usually persistent and quite annoying, sometime even going out of their way to harass the debtor.

Can bank account be garnished if filed by collection agency rather than original debtor?

Yes, it can be garnished by a collection agency (CA). What happens is that the original credit sells the debt to the CA. Then the CA owns the debt. The CA tries to collect from you. If you don't pay, they can sue you. If they sue you and win a judgment, they can garnish your wages. Of course, the CA may be suing you for debts that are not yours or where the statute of limitations has expired! Learn your rights by reading up on the FDCPA.

Is it legal to reissue a warrant after you sell it to a collection agency?

In general, once a creditor sells a debt to a collection agency, they transfer the rights and ownership of that debt to the agency. As a result, the collection agency becomes responsible for attempting to collect the debt. In most cases, the original creditor no longer has the authority to reissue a warrant or take direct legal action against you for that specific debt. However, laws regarding debt collection can vary by jurisdiction, and there may be specific rules or regulations that could impact the ability to reissue a warrant in certain circumstances. It's essential to consult with a legal professional who is knowledgeable about debt collection laws in your area if you have concerns or questions about your specific situation. They can provide guidance tailored to your circumstances and the applicable laws in your jurisdiction.

If a collection account was sold to another collection agency is it correct that they should both show up on your credit report as late payments?

When a collection agency sells your debt they no longer have any claim to your debt. It's like selling a car, once it is gone it is gone.

How long do you have to pay a charge off?

Charge offs' are when a creditor writes off a debt as a loss which usually take place 180 days after the initial missed payment or delinquency. Being as though the debt is still owed, the original creditor sells your debt for pennies on the dollar to a collection agency who tries to enforce collection of that debt which they now own or have been assigned. So to answer your question it can be paid anytime but, after the debt has been charged off you can now negotiate for a settlement of of lessor value than it originally was.

When a credit card company sells your account to a collection agency how much do they sell it for?

I'm not sure for certain, but I would say they sell it for pennies in the pound.

What is the time limit imposed on a collection agency to validate a debt?

If you legally incurred the debt then you are responsible for it until it is paid. A company other than the company to which you were originally indebted may purchase the rights to your debt and you are responsible for paying them. There is no time limit on that debt. A collection agency can legally pursue you until the debt is paid in full. However, there is a time limit on the negative consequences of not paying the debt. In most circumstances that limit is seven years. Seven years from the time you became delinquent with your original creditor. Whether or not your debt was purchased by a collection agency, it should not be reported on your credit report or affect your credit score after seven years. The only time the debt could reappear is if you take an action on it. For example: In 1997 you applied for and received a store credit card and charged $1000 in merchandise. You did not pay the bill and after their attempts to collect the debt fail, the store sells your debt to a collection agency in 1998. That agency sells your debt to another agency in 2000. In the meantime, you pay all your bills on time and have an otherwise spotless credit history. In 2004 your $1000 debt will no longer appear on your credit report and your credit score will be higher because the old debt is no longer figured in the calculation. The collection agency is not doing anything illegal by contacting you regarding your debt. But it is no longer affecting your credit rating. In 2007 you pay $500 toward the debt. Your credit report would reflect you have a $500 debt to the collection agency and your credit score would drop. I hope this answered your question.

My account balance with American express has been turned over to a collection agency. Does American express over a reduced payoff as a settlement?

when a company "sells" a bad debt to a collection agency it is at a fraction of the total bill due. So, if you have a bad debt to American express in the amount of $10,000, more than likely it was sold to the collection agency for 2-3000. The remainder can be written off by American Express on the taxes that are filed by the company. What you can do is contact the collection agency after saving 40% of the debt (or 4000) and offer to negotiate a settlement. If you settle for $4000.00 you are saving $6000 and the collection agency is making 50-100% profit on the bad debt. This what the debt settlement companies do - no sense in paying the settlement company fees when we can negotiate ourselves.
