The question of whether or not Cromwell was breaking the law when he attacked Drogheda is difficult to answer. Cromwell was a rebel who had overthrown the Monarchy. He had illegally seized the government of England. He had also illegally seized the government of the Pale of Ireland which included Drogheda. Still, he controlled the lawful government of that area at the time. Arthur Ashton, the leader of the Irish rebels at Drogheda, refused to recognize Cromwell as the lawful ruler. He sided with those wanting to restore the monarchy to Ireland. He decided to fight to the death rather than recognize Cromwell.
