It has been released along with the rest of the series. I believe it came out in 2006 in Japan and 2007 for the US. Surprisingly, unlike most manga, Death note was made into an anime the same year as the manga came out. The episodes were behind though, and the extras made sure to give enough time for the manga to come out.
According to How to Read (Death Note, volume 13), L ate a banana on October 28, 2004. This would correspond to some time towards the end of volume six or at the beginning of volume 7, definitely before chapter 58 (in which L dies). In the anime, this would be in or before episode 25, after episode 19.

Volume nine was released on October 29, 2008. At that time, my sources had me under the understanding that volume 10 was still being created/drawn in japan, and thus not yet released even in japan. I would give it a few more years as it usually takes the artist/writer that long, not counting the six to twelve months it takes for translating it to English~
