In order to use someone's work of art (and video and music is considered work of art), you have to get permission from that person (in most cases, from a company such as RIAA). If you don't have the persmission to use their work or create derivative works from it, the work in itself is illegal and cannot be distributed at all, through YouTube or elsewhere.

If you are sure that you have the right to use the work and create derivative works from it, and YouTube still takes it down, contact them and cite the license you are given for the work (be it a personal license from the author, or a license akin to GPL or CC). Saying that "I can do that because no-one has licensed this or nobody has said that I can't" isn't an excuse to make illegal use legal. Copyright automatically covers any and every creative work, unless the author(s) decide it to be otherwise.

It depends. If the video is using clips from the actual anime, then it is an AMV. Tributes don't always have that. Tributes are music videos, usually dedicated to a character. Usually, they are the same thing as AMVs. My first AMV was a tribute to all the villains of Yu-Gi-Oh. I've also done a Hetalia England tribute.

Yes, they are, but only user uploads of anime (like (insert anime here) episode x part 1/3, etc). However. legal anime uploads on youtube, like ones from 4kidsTV of animes such as Sonic X or Kirby or Yu Gi Oh are not deleted. They sometimes delete/mute amvs with WMG songs, and remove some other anime related remixes though, they are somewhat picky about what they delete.

Anime videos (amvs) are not compatible formats for Windows Movie Maker.The best material you could use for amvs would be RAWs (Original Japanese Audio/Videos). RAWs usually have the best quality, don't have any subtitles to get in the way, and are in a format that Windows Movie Maker can handle (.avi).The only place that you can reliably get RAWs at though is via bittorrent.

the bad sides of youtube vary depending on what you do on youtube. amv makers (amv is short for anime music videos) such as myself (wlofjaw is my username on youtube and hear) are constantly getting our videos muted and removed because we do what we do best, make good amvs for pure entertainment. the videos are removed/muted because youtube's search engin will look for videos and suspect them of being for profit even if the maker claims they arent. -_- also streams used to have links to them that were on the stream makers channle that would give a number of how many users were in it and its name. but those sudenly disapeared one day... also builitins have changed from apearing on a users channle and onto the home page that no one realy spends time on and the builitins don't even stay for more then 5 hours. youtube is constantly changing so its never realy possible to name all the bad changes and good changes...
