However, on April 19, 2013, the band released the following statement on Facebook:
The dispute between Benjamin Burnley, who is the sole founder, primary musician, singer and songwriter for the band Breaking Benjamin, and two of the bands ex-members has been resolved. Benjamin Burnley retains his right to use his band name and Breaking Benjamin will continue.
With the end of the hiatus, it can confidently be assumed that a new album will be on its way.

Its still in the works.
The band aren't making music at the moment, and I doubt there will be an album this year, but they haven't broken up, so they may make another one eventually.

Breaking benjamin haven't actually released a new song in a while, but there newest songs in terms of production are all on the album "dear agony". In terms of release, however, there are 3 previously unreleased songs on the compilation DVD, "shallow bay". These songs are "better days", "lie to me" and "ladybug".
They will start making a new album in April or may of 2011. Lars ( Ulrich: Drummer ) said that they will be making a new album then.
Breaking Benjamin did not break up. *Rumor* has it that 2 members were fired [By Ben Burnley] for making unauthorized decisions concerning the band, including the 2011 re-release of "Blow me away" featuring Valora [this was not a new song, simply a redone song with valora singing to it]. It is unlikely there will be a new album in 2012 due to Ben's ongoing health problems. One of the last posts on shallow bay [the band's official website] addressed the internet rumor of the band's split up and briefly brings up the health issues, but does not specify what he has going on.

On Sept 29th 2009 they released their newest album Dear Agony. Though, i have not yet heard of anything for 2011.The news from their official website has no new news for the year 2011 at all. The last news entry was in Aug 16th 2010.
