Unfortunately for you, it is the BANK that declares a check NSF, not the merchant. The merchant MAY have submitted it early in error, or simply didn't care. Technically and legally, you should not have written it knowing there was not enough money to cover it, but you relied on the merchant's alleged suggestion and it's really the merchant with whom you have the beef. ... just don't expect any satisfaction from them.
