The right to an attorney is one of the Miranda Rights that every person is entitled to in the United States.
In the United States constitution it is the sixth amendment that covers the right to a lawyer with Assistance to council right in which a criminal defendant has, under the sixth amendment, the right to be represented by council.
The 5th amendment of the United States Constitution guarantees the accused to a lawyer. Also the person has the right to remain silent and not speak to police.
