The Legislative branch, otherwise known as Congress, is the one who is supposed to have the power to declare War against another country. Unfortunately in recent years that hasn't been the case in America.
The US President must ask Congress to declare war.

Congress (Legislative) However, the prez can order the army during a time of crisis for 90 days without the permission of the congress. Afterwards, he has to ask the Congress to officially declare war. So, yeah, the legislative branch declares war:)

No Germany declares war on US
The Judicial branch has the power.
Congress declares war and authorizes spending. The executive branch is in charge of running the military and waging war. (See Article 1, Section 8.)
Poland was allied to Franch and Britain, so germany had to wage war on those countries as well.
No president has declared war on Britain. As a colony, the US fought for independence, but the government under the constitution was after that. In any case, Congress is the branch that declares war, and they have not done so.
