If the US Supreme Court declares an Executive Order (Presidential action) unconstitutional, it is checking the Executive Branch.

The Legislative branch, otherwise known as Congress, is the one who is supposed to have the power to declare War against another country. Unfortunately in recent years that hasn't been the case in America.
No Germany declares war on US

No president has declared war on Britain. As a colony, the US fought for independence, but the government under the constitution was after that. In any case, Congress is the branch that declares war, and they have not done so.
