The Constitution breaks the government into three sections. They are the Executive Branch, the Judicial Branch and the Legislative Branch. The legislature is authorized to create and pass laws.

Article Two of the United States Constitution covers the executive branch of the U. S. government. The article contains four sections. The executive branch includes the members of the president's cabinet.

It all really depends if the countries government follows a Constitution like the United States. If a country does have a Constitution like the one of the US then powers are specifically defined in the document.

Article One of the United States Constitution establishes the legislative branch of the federal government, the United States Congress. Article Two creates the executive branch of the government, consisting of the President, the Vice President, and other executive officers and staffers appointed by the President, including the Cabinet. Article Three establishes the judicial branch of the federal government.
The Judicial Branch of the US government is made of several sections. At the top is the US Supreme Court. After that comes the US Court of Appeals. The next level are the individual district courts.
Lincoln was in 2 branches. When he was a congressman, in the Legislative Branch. When he became the President he was in the Executive Branch.
