Not sure about where you live but here in my area you CAN NOT even sit in the car, front or back while intoxicated! Even if you are waiting for someone to pick you up, you can not be in the car unless you give someone else the keys! If you are in possesion on your keys and sitting in the back seat or laying down etc. you CAN BE CHARGED!!
This is new information for me that I had just found out a few months back as my son had called for a ride home one night from a bar as he knew he had more than legally allowed and called home for us to pick him up.
