It would depend a bit on the laws of the area, but usually the requirements put on bike lights are all about the bike being visible, and not about what the rider can see with them. The bike rider not seeing the open door because he didn't have any lights would not clear the car driver from responsibility, but the car driver not seeing the bike rider because he wasn't using any lights just might.
The driver.
Even though the driver didn't have anything personally to do with it, the driver is responsible for the vehicle, incl the passenger(s) and what they might do.
If the taxi driver was in the middle of the road then it wold be the taxi driver fault but if the taxi was on the side of the road then the dumb taxi driver should know that the rule is to open on the right side either way! duhhhhhhhhhhhhh
The passenger because he should have looked for cars before he opened the car door.
driver of parked vehicle
The person who opens the door.
The driver/passenger opening the door is at fault. Look it up under the traffic laws in your state.
Driver - The driver is what casued the incident. Even so, while exiting, person becomes pedestrian, not a passenger
The person that opens the door is at fault
Initially the driver has to pay the damages if anything besides the car was harmed or damaged but he can sue the passenger for the same amount and also for damage to the car.
Nope... The passenger's actions are their own ! If they choose to open the door of a moving vehicle - they are responsible for their own injuries !
No they do not, only the driver side window, passenger side window, and sunroof are the only one that opens
Dextral opens to the right, sinistral opens to the left.
The person in the car is to blame because the person riding the bicycle would have no way of telling when the car door would be open. the person in the car could have easily looked in the side mirrors and could have seen if someone riding a bicycle was passing by.Added; The traffic offense charge would be "Opening Door to Traffic."
