Entrapment is an affirmative defense to most criminal charges stemming from a law enforcement officer or agent of a law enforcement agency inducing the alleged defendant into committing a crime that he would not otherwise commit. The person who lures into person into the crime must be involved for the crime to commit.

Another View: (In US criminal law) A person is 'entrapped' when they are induced (i.e.: "egged on") or persuaded by law enforcement officers or their agents to commit a crime that they had no previous intent to commit.

However, there is no entrapment when that person is ready and willing to break the law and the government agents merely provide what appears to be an opportunity for them to commit it.

What occurs when a government agent deceives a defendant into committing a crimes?

The term for being coerced into committing a crime is "entrapment".The law enforcement officer doesn't necessarily need to deceive anyone for entrapment to occur. Any crime that results from an officer's initiative is considered entrapment.Entrapment can be considered a legal defense. If the defense can convince the judge or jury that entrapment has occurred, the defendant will be acquitted of any charges.

What states is the entrapment defense used in?

It could be used in any state, but it is often misunderstood. It is NOT that you were caught, it is that you were caused or encouraged to commit a crime that you would not have committed, OTHER than for the encouragement. If I was to ask you if you wanted to buy a ring, sold you the ring, and THEN arrested you for possession of stolen goods (the ring), that may be entrapment.

Do the police call in a phony sales call and try to get as many people into the house in which they're about to raid?

No. That would be an illegal procedure known as entrapment, which if proven would result in all the charges being dismissed. No police department would take that risk.Another View: Since the questioners definition of a "phony sales call" is not known, the first answerer should not have assumed that this would be an "entrapment" situation. It has been known to occur that, in an effort to determine if a certain wanted individual (or individuals) may be present in a location, that a call has been placed asking to speak to that person (or persons). When confirmed by phone contact that probable cause exists to believe that the wanted individual(s) is/are present at the target location, the warrant can then be served with no fear of an entrapment defense being successfully raised.

What is the pleading that contains the defendant's legal defenses?

Guilty with explanation. An affirmative defense: a defense to a criminal charge in which the defendant generally admits doing the criminal act but claims an affirmative defense such as duress (he or she was forced) or entrapment. In effect, an affirmative defense says, "Yes, I did it, but I had a good reason."ReferencesGardner, T. J., & Anderson, T. M. (2008). Criminal law. Belmont, CA: Wadsworth Publishing Company.
