Ah yes, the infamous brake light switch is your problem.
Underneath the driver dash, look right above the brake pedal, there is a little roundish kinda piece there that is the brake light activator. It should be fully compressed while the brake is at normal spot. If there is a small nub comming out the end of it touching the brake arm, that's your problem. Loosen the nut on the end and move the switch up more so its compressed against the arm, if that doesnt work, the switch needs replaced with a new one. Very cheap, and easy to fix for anyone!
Basically how it works, is when the little button is pushed in by the brake arm at normal spot, it disconnects the power going to the brake lights.
But when the button is out, is allows the current to go thru, thus leaving your brake lights on!
Brake light switch is stuck or defective.
My 2000 Toyota Tundra Truck, the brake lights come on when your not pressing on the brake paddle. Not even even if the car is on.
In my experience, when brake lights remained on even after stopping and shutting off the car.....many times it was the brake stoplight switch, usually located on the brake pedal arm up above the pedal.

It sounds as if you have an electrical problem that needs to be checked. You may even have the wrong fuse for your brake lights.
It turns the rear brake lights on as a safety feature. The brake pedal is pushed in, causing the fluid to move forward in the brake cylinder,activating a brake light switch. Even if the vehicle is off, the lights will still come on.
Out of adjustment. Adjust the mounting of the switch so the brakes lights are off until you press the brake pedal.
check and/or replace brake pedal switch.
Could be the brake light switch above the brake pedal.
they are not brake lights they are fog lights and they turn on because it is for the car behind to see you
