I assume you are talking about M rated games. M stands for mature, meaning that you should not be able to play said game unless you are over a certain age, Microsoft enforces this by having a check of your birth date (as it is on your windows live ID and/or what you said when you made your Xbox live account.) If your age is lower than the requirement of the game then you are unable to download it.
my suggestion to fix this problem is to create a new windows live ID, unless you have some way of changing your registered age on Xbox live, but I do not believe you can do this.

To download arcade games you need xbox live, but all you need is a silver membership which is free.
