The Smith Act made it unlawful to teach or advocate the violent overthrow of the US government. This was especially aimed at communist, socialist, or fascist groups whose members or platforms advocated seditious acts.
The law was never repealed but many convictions under the act were overturned on Constitutional grounds.

Vladimir Illytch Ulianov (Lenin) along with Lev Bronstein (Trotsky) were the prime movers in the Russian revolution in 1917. They went on to establish the USSR, the Union of Soviet Socialist Republics, the most powerful Communist nation in history. After Lenins death in 1924 Stalin became its leader. Trotsky was murdered in Mexico in 1940. The political group Lenin was associated with was the Bolshevik Party, a small but radical faction of the Marxist Russian Social Democratic Workers Party. In March 1918, the Bolshevik Party changed its name to the Communist Party.

The Communist Party has run candidates for president in some states. They have never had a serious candidate for any high office in America. The Communist Party has been banned at times because of a platform calling for the violent overthrow of the US Government. CPUSA crusader Gus Hall was nominated for President four times (1972, 76, 80 and 84). He did not win much support. His best year was probably 1980, when he garnered less than one-tenth of one percent of the vote, about 58,700 votes nationwide.

This Act was used to prosecute socialists in 1941, and later communist party members in the 1950s. This law is still on the books, although many of the convictions under it were overturned.
