Because Brokentail was still alive and a prisoner in the ThunderClan camp.
Nightstar, being a line from the series Warrior Cats, did not receive nine lives because they did not become the leader of their Clan through the traditional process of being chosen by StarClan. Nightstar was appointed leader by Brokenstar, which went against the normal Clan tradition.

I don't think anybody knows EXACTLY who gave him his nine lives except the Erins.Obviously, it was from StarClan.A few good guesses would be Nightstar, the last realleader of ShadowClan, and any other good cats who died in battle or otherwise.But unless the Erins write about it, it's never really mentioned in any of the regular books :P:)
