The spider man movies were to old for the new avengers movies. They needed to have spiderman at a accurate age which is why the new spiderman movie starts his story over so he can possibly be in Avengers 2 which comes out in 2014 i think
There's two sides to this, the first side is Peter Parker wasn't typically seen as a member of The Avengers typically the only Spider-Man that had associated himself with the team was Miles Morales and the second reason has to do with licensing issues so that they could get the rights to use the Spider-Man and Peter Parker characters in the movie.

The only Avengers incarnation that was around in 2010 was the DisneyXD series, Avengers Earth's Mightiest Heroes & Drake Bell voiced Spider-Man but the episode he appeared in wasn't aired until 2012.
