Yes, the film rights for Spider-Man were finally acquired by Marvel in an agreement w/ Sony in 2015 & he appeared in Captain America Civil War and then in Infinity War (Part one & Two)
No one plays him because #1, there was no Avengers film in 2010. Avengers wasn't released until 2012, & #2, Spider-Man wasn't in The Avengers. The only Avengers incarnation that was around in 2010 was the DisneyXD series, Avengers Earth's Mightiest Heroes & Drake Bell voiced Spider-Man but the episode he appeared in wasn't aired until 2012.
