Spider-Man officially joins The Avengers in the comics during the "Breakout" story arc in New Avengers #1 (2005). In the Marvel Cinematic Universe, Spider-Man joins The Avengers in "Captain America: Civil War" (2016) and later becomes a more permanent member in "Avengers: Infinity War" (2018) and "Avengers: Endgame" (2019).
No one plays him because #1, there was no Avengers film in 2010. Avengers wasn't released until 2012, & #2, Spider-Man wasn't in The Avengers. The only Avengers incarnation that was around in 2010 was the DisneyXD series, Avengers Earth's Mightiest Heroes & Drake Bell voiced Spider-Man but the episode he appeared in wasn't aired until 2012.
he was not an original avenger

No. He will not be, was not in, the Avengers: Age of Ultron.
Yes, the film rights for Spider-Man were finally acquired by Marvel in an agreement w/ Sony in 2015 & he appeared in Captain America Civil War and then in Infinity War (Part one & Two)
he was not an original avenger until fury ran into him and added him in the comics.
Because Sony is in charge of Andrew Garfield and the directors of the avengers are not sure yet to let Spiderman in its a 10% chance that he will be in it
