Yes as the children are minors it would be the drivers responsibility to ensure the kids are buckled up. It is the School Bus drivers responsibility to ensure that all students comply with the seat belt laws of their respective states. If there is an accident, and a student is injured and it was found that the seat belts were not being used, the fault lies solely with the School Bus driver.
