This is not a legal question it is a question of personal 'ethics.' If the person in who's name you are donating has specified a particula charity, it would be proper to honor their request. However, if the person has stated that a contribution to ANY charity in their name is satisfactory then YOU could make the choice. If you are honoring the person, honor them by respecting their wishes.
A trust is set up by a person donating to charity and transferred to the property to be donated. The charity involved must be IRS approved, or in other words, the charity must have tax-exempt status.
