Why should talking on your cell phone while driving be a crime?

Generally speaking, you have to concentrate more on your driving while talking on a cell phone. You should feel this as you are talking and understand that you have a greater chance of having an accident or running a red light unintentionally or etc.
An interesting phenomenon: I have used the nextel direct connect procedure (2 way talk button), when talking to friends while driving and don't notice a difference in concentration. (Using a nextel phone 2 way near my lap like a 2 way radio etc). However when holding a cell phone to my ear while driving and trying to talk on the phone I notice a lack of concentration while driving. WHY IS THIS PHENOMONEN NOTICED?
What is the mental difference between holding a cell phone to your ear and using one in your lap in the direct talk mode????
