As for why a government would, there's a number of potential reasons. The necessary evidence to make a case may not be present. They might reach an agreement with that arms dealer where the dealer becomes an intelligence asset for that government. The arms dealer may be selling arms to "enemies of their enemies" which the government themselves aren't willing to equip. The possible reasons are pretty vast.

You MAY be able to get it from the dealer that sold the handgun. In most of the US there is no process to register handguns with any government agency, but the dealer ertains a copy of the sales paperwork. You would need to know which dealer, and when the gun was purchased.

You would need the correct Federal Firearms dealer's license, that permits dealing in automatic weapons. Its likely however that the US government would consider the weapon still to be government property.

There are several reasons. Evidence has yet to be produced. It is difficult to charge a government with war crimes and it was a government decision. It would reflect poorly on other countries. If he was found guilty many others would also need to be charged.
They do not want to plead guilty and therefore accept responsibility, but evidence against them is so strong that if they take it to trial they acknowledge that they would be found guilty.
