Yes. jailbreaking could damage your iPod touch by slowing it down (not significantly, but it does slow it down). also the jailbreak might not always work. my diagnostic for that type of problem is wrong firmware or bad publisher of the jailbreak software.

ok, i tried to jailbreak my ipod touch 1st gen, i left it to do the jailbreaking and it turned itself off. now when i try to turn it back on, it just shows the apple symbol, same as normal when starting up, but never loads up. I have tried holding the home+sleep button to reset it, i have tried charging it. I would say jailbreaking is more of a 50/50 chance it will work or break your ipod.

First off I would like to warn you that jailbreaking your iPod is not the best thing to do but if you are sure you want to do it then go to blackra1n.com or spirit jailbreak they both work pretty good and I've never known anyone who had a problem with either of them. And lastly jailbreaking your iPod is not illegal in any way shape or form unless you use your jailbreak to steal music,apps,movies,etc.
