Yes. You cannot just force a minor to leave. If she leaves on her own she would be a runaway and you would be charged for helping her.
To take a Minor child abroad with intent to reside abroad without the consent of the non custodial parent would constitute kidnapping. A vacation is not a change of residence and therefore is not disallowed. Permission should be obtained from the non custodial parent in writing to prevent any misunderstandings later.
The parent would be charged with kidnapping.
If the noncustodial parent tries to keep the child, the custodial parent can get the noncustodial parent charged with kidnapping and contempt of court both can be jail time for the noncustodial.
no you cant it would be considered run away and your friend and their parent or parents or gardian can get in trouble for kidnapping...just wait tell ur 16 and try to get emancipated
Yes. He would need her consent if she is the custodial parent.
Yes, because she is a minor it would be considered kidnapping. Response : I posted the question, and we have already contacted the police and they are looking into the code, but evidently it is NOT considered kidnapping because it was not against her will. I don't understand how it is illegal for a non-custodial parent to take his OWN child across state lines without the custodial parents consent, but a guy can take MY child across state lines without my consent? There is something wrong here......
No you cannot. That would be classified as kidnapping across state lines in the event the parents decided to go after you for it which is a federal offense.
Yes, a minor in Michigan is subject to their parents and they could report a runaway and kidnapping.
Yes. The fact that the parent brought the child to the dentist 'implies' consent to treatment. This is not as compelling as a signed "informed consent" but if it can be established that the parent did or reasonably should have understood that the child would be treated, then implied consent may be sufficient defense against a claim of non-consent.
No, not without the consent of the minor's parents. The alternative to not getting that consent would be an all expense paid stay in the prison facility of the State of Nebraska's choice. Technically, can you say kidnapping?
One parent is not allowed to take the child out of the country with out court approval, and/or consent of the other parent. So, talk to your attorney, child services, or you can even call the police and file a charge for kidnapping, if the child is underage. See related question link.
you would have to take the matter to child services but i believe so.
