I THINK SO. THE CONTRACT HASN'T BEEN COMPLETED UNTIL THE DOWN PAYMENT IS MADE. HE'LL PROBABLY VOID THE CONTRACT FOR FAILURE OF PAYMENT.

What is the standard on payment plans for a kitchen remodel?

There is no standard on payment plans for a kitchen remodel. There are typical payment plans where a deposit is paid when the contract is signed, which is generally 1/3 of the total cost of the project stated in the contract. The second payment of 1/3 is given at the half way mark. Then the final payment at job completion.

You signed a contract for a used car and got it financed but never took the car out the lot nor insured the car is the contract still binded?

If you signed the contract, the car is yours. The dealer can have the car towed at your expense if you don't take it away. it depends on the laws of the state in which the sale took place. a deposit on a car for example is always 100% refundable. no matter what any payment given to the dealer prior to delivery, either to "hold" the car or for the downpayment and the contract wasnt signed all monies are 100% refundable. if the contract was signed and the customer never took the car off the lot then the each state has its own laws about money being refunded. if the customer signed a contract, insured the car and drove the car off the lot then the car is 100% the property of the customer. and unless specifically noted in the sales contract may not be returned. this is know in the car business as a "cooling off period"

What can be done if personal check was given to title co and then noticed a written change in contract not seen until you got home?

If the change in the contract was made after you had signed it you should complain immediately and ask the bank to stop payment on your check until the matter is resolved. If you signed the contract without reading it and you missed the change then you are in a very exposed position. In either case you should contact your attorney immediately.

What is the time period given before a car can be repossessed by a creditor in new york state?

Read the contract you signed. it likely states that when in DEFAULT, the lender can repo the collateral. Default is when you dont pay a payment as agreed or any other condition of the contract. No rocket science here.

How do you write a letter to hold cheque?

If you have written and signed this cheque and given it to someone to pay for something then, in most countries, it is not lawful to hold payment on the cheque. If you have a problem with what you have purchased then the law of contract or consumer protection laws are your recourse.

Are you bound to purchase a car in Idaho if you've signed the paperwork for a it but you haven't taken delivery or paid a down payment and the trade-in is in your possession?

If you still have the title to the trade, you may not have effectively given a down payment. By turning over the title you have given down payment and that establishes the rest of the contract. For a contract to be enforceable you have to sign the papers, take possession when appropriate and pay some amount of money. Signing the loan papers MIGHT be considered paying for the vehicle, depending on the laws in your state. If you know the lending institution you can decline up to the point when the funds are disbursed.

Can landlord sell land you are buying from him on contract?

If you have a signed and notarized contract with him for the purchase of land, call it "parcel A", he cannot then go and sell "parcel A". Unless you have violated any of the sections of the contract, for instance, with a late or missed payment. And if you did, the contract would not necessarily have to say that it would void the contract, that could be taken as a given. (You'd need an attorney to know for sure on that last point.) You need to take your contract, and record of payments, into an attorney in your area and learn of what you can do. Meanwhile, keep making the payments, and do not be in breach of any section of that contract.

Can you back out of a car deal after the papers are signed but the cash down payment was not given and the car was NOT taken off the lot?

More Than Likely. As long as the papers have not been sent in or filed on a government PC, then there should be no problem unless the car dealer is obstinate and problematic.

Can a dealer rescind an offer if they had given the buyer 30 days to decide offer?

If the 30 day offer was part of a formal contract which both you and the seller signed, during which the seller agreed to hold the item for 30 days while awaiting your decision then, no, it probably is not enforceable in law.

If I signed a document but didn't read the document and found out later it was a contract and it was misrepresented to me orally by a salesperson am I bound to the contract?

If this was a salesperson that came to your door, you have 3 days to nullify the agreement. If you went to a store or establishment and signed it, you are bound by the written agreement you signed.
