Your Ipod touch battery empties itself quickly when you are playing videos or music even though it says the new Ipod touch which you have can play videos for 6 hours What is going on?

It's the reason that Apples been sued for at least 2 times, they say that the battery will last longer then it really deos, just playing music nonstop will last about 6 hours instead of 36, video hours are less then that.
