By Personal experience... I got married to my Husband who was illegal here with an EXPIRED passport of his country and we still got the marriage License. I suppose that someone might say that the marriage was entered into solely for the purpose of obtaining residency status for your husband, but that should have come up BEFORE the green card was issued, not now.
