You need to be the executor or administrator of her estate, which requires filing with probate otherwise you need another form to get the refund or pay any taxes due the government. You must write her name on the top of the tax form, the word deceased and the date of death.

Then i was told it had to be sent to the IRS not efile. My daughter's 1040 EZ was sent in 1/24 and has been received and processed and should be sent out by 2/15. I had asked for direct deposit but don't know if that can be done where we had different last names. My daughter died in Florida, where they don't have to file State returns and I live in Maine, no problem as long as the check doesn't get lost in the mail, I will just take the probate paperwork in the bank with the check.
