Definitions of crime and laws: Crime: The act of bracking the law. Criminal law: the law dealing with crimes and their punishments. Civil law: Civil law, as opposed to criminal law, refers to that branch of law dealing with disputes between individuals and/or organizations where do laws come from : laws where first introduced in the 1890's, but it was only really tacken in to action in the early 1900's.
A judge cannot stop you from making a plea deal with the prosecutor, but he does NOT have to accept your plea to a lesser offense. EXPLANATION: The prosecutor (with who you make the plea bargain) is a member of the EXECUTIVE BRANCH of government. The judge is a member of the JUCICIAL BRANCH of government. When the prosecutor makes the deal with you he cannot speak for the other branch of the government. If the judge feels that the plea deal is too lenient, or that your crime was too heinous to be reduced, he does not have to accept your plea to a more lenient deal.

To answer this question we must examine society and the hierarchy of the government. Who decides what is law rules what is a crime. By breaking the law one commits a crime. Without the law there would be no crime, this is excluding moral and ethic code. Say a law of censorship is passed and anyone that watches explicit sexual videos is fined and jailed. Before the law was passed the crime did not exist, or happen, because there was no law to break and no crime to commit. In a sense law creates crime by making rules.
