I don't think any part of the Constitution guarantees equal treatment under the law. Individuals are taxed at different rates, and business owners' efforts are regulated by government, but people who don't own businesses remain unregulated, even when they act in the same manner. For example, use tax is owed by all individuals, but only businesses and their owners are audited on a regular basis to ensure compliance. I know of no government auditing of individual actions in that regard, nor in regard to other similar areas, like advertising.
