That's an interesting legal question, which will likely never be answered as there are no longer any Neanderthals around.

If they still existed, I think that they would probably have the same rights as the Prawns in the film District 9. I would prefer equal rights though. Then again, I would campaign for equal rights for rabbits if I could!
