You need to have a Groudon caught in SoulSilver and a Kyogre from HeartGold (that is, not transferred from Emerald, Ruby, Sapphire, etc).

For some reason those are the only exceptions to the rule of legendary Pokemon maybe because the rest of the legendaries are overly powerful.
