You need to apprise the landlord of any tenancy change. This is to protect either party in case of legal issues that may arise down the road in time. The other reason is that in order to close or terminate the present lease, both parties must sign the documents.

It is a binding agreement but you could try talking to your landlord and explain the situation they may be able to help. yes,you just both have to sign on the lease that you are quiting the lease and they check to see if he makes enough money to stay there.
