I recently had the same problem on my 2001 Honda Odyssey and found that there is a little switch called the "brake pedal position" switch which not only turns on your brake lights when you are braking, but also allows you to switch out of park when depressing the brake pedal (due to the child safety feature). It is a siple part that can be switched out within 10 minutes (or less) if you have a single wrench of the correct size. The "Haynes Repair Manual" for the 1999 to 2004 Odyssey contains the information to change it in section 9-14 in the "brakes" section. Good luck!

I can only assume that this is in reference to the gear shift on the 2002 Odyssey. I had to ask a dealer mechanic, who had to play around with the shift lever, before finding out it was just how it was made. When shifting normally, one has to pull the shift lever TOWARDS you and then move it up or down to the top gear positions (P, R, D, N). In those cases, you would be applying brakes and not moving. When shifting in the lower drive gears you can be moving, but you need to push the gear shift lever forward, or away from you and move it to the approppriate lower gear (2, 1, etc.).
