most times the person backing......rules of the road will dictate that the person backing must use a higher degree of care......nearly all claims I've worked where one is backing and other vehicle is moving forward, and certainly if stopped the backing party will be found fully or higher percentage at fault........
Based on your description the car that backed into the other car should pay for the damages. You can't get a ticket for backing into someone's car unless they were either drunk or had no license, both instances in which police should be summoned.
Don't force the wording of the event and I believe the answer to: "...when you back into someone....", is evident. Add to it, "...when exiting a private driveway...", where one is always required to yield to the traffic on the public street.
The backing vehicle is at fault. We are always supposed to look to ensure the path is clear before placing our vehicle in motion.

If your state requires your legally registered vehicle to be insured at all times, your lack of insurance MAY be of some interest to law enforcement. HOWEVER - if the other party's vehicle struck your vehicle then THEIR insurance is liable of the damages. It makes no difference whether or not your insurance was in effect at the time, or not.
Backstabbing = Talking about someone or doing something behind their backs. You can lose friends that way.
