Brake light switch is stuck or defective.
check and/or replace brake pedal switch.
My 2000 Toyota Tundra Truck, the brake lights come on when your not pressing on the brake paddle. Not even even if the car is on.
In my experience, when brake lights remained on even after stopping and shutting off the car.....many times it was the brake stoplight switch, usually located on the brake pedal arm up above the pedal.

It sounds as if you have an electrical problem that needs to be checked. You may even have the wrong fuse for your brake lights.
It turns the rear brake lights on as a safety feature. The brake pedal is pushed in, causing the fluid to move forward in the brake cylinder,activating a brake light switch. Even if the vehicle is off, the lights will still come on.
Out of adjustment. Adjust the mounting of the switch so the brakes lights are off until you press the brake pedal.
Could be the brake light switch above the brake pedal.
they are not brake lights they are fog lights and they turn on because it is for the car behind to see you

You probably have a faulty brake light switch
The rear lights of your car will still on even if your car was off because the switch was turned on and it will still remain on until the battery's out. Another possibility, if the headlight switch is off and the ignition switch is off, the brake light switch may be out of adjustment or broken and what you're seeing is the brake lights on.
