Yes, a ticket for no tail lights will go on a persons record. It can be dropped if the person gets the problem fixed before the court date on the ticket.
The fuse is an option. If the other is working the fuse is fine. It almost has to be in the wiring. There maybe a short or pinch in the circuit. If neither are working check every single fuse in the box. Long process, but sometimes other insignificant fuses help control unusual cicuitry... I once had my horn quit over an unlabeled fuse although the horn fuse was fine... I had a wire let go in mine, they do not put enough slack in the wires so it is constantly under tension, so when the wire starts to corrode it will snap and not allow the running light to come on. Almost cost me a $100 ticket, and it did cost me a $125 repair bill ... go figure keep in mind that the daytime running lights are your brights it may be those bulbs that are burned a high beam is probably out check them
The presumption is that if you were rear ended, the other driver is at fault. The brake lights not working is a mitigating factor, but the bulk of the blame still goes with the other driver. Insurance doesn't have any relation to fault. But it coculd get you a ticket.
