Depends on which state you live in.

Not neccessarily. It may very from state to state and some states actually require full safety inspection as opposed to smogging but in Nevada (unless you're a dealer) you are not required to smog a vehicle prior to sale but the person who buys it will have to pass a smog inspection before they can register it with DMV.

Can a dealer sell you a car that will not pass a smog inspection?

Yes, a dealer can sell you a car that will not pass a smog inspection, but they are typically required to disclose any known issues that could affect its emissions. In many states, such as California, dealers must provide a smog certification for used vehicles sold, unless the car is exempt or sold "as-is." If a car fails a smog inspection, the seller may be responsible for repairs, depending on local laws and the terms of the sale. Always check your local regulations for specific requirements and protections.

Is the buyer or seller responsible to smog a car if the car is sold from California but buyer is from Iowa and will be registering it in Iowa?

What do you mean smog a car? If car is sold "as is", buyer is responsible for all mandatory smog control equipment. If you mean pass a smog inspection, there are none in Iowa.

Can you sell a car in California and leave the smog up to the buyer?

No, it is the seller's responsibility to provide the buyer with a Smog certificate that is less than 90 days old when selling the car. The law makes no provision for "as is" sales in this matter. I went to the DMV today as I purchased a car that was not smogged and I cannot locate the seller. I was told that I could sell it as is by 2 DMV personnel. Now I am really confused.

When going to the dmv after buying a used car do you get the smog certificate before or after you go to get it registered or do even need to at all it was smogged just two months ago in may?

Check with your local DMV for how long a smog cert is good for but you will need it before you go to get the car registered.

Is it illegal to sell a non emissions car to a smog state with out previously telling the buyer?

Cars are only required to meet emissions standards as of the date of production. If it was produced before emissions were installed in vehicles, then the car is legal. I would inform any potential buyer of this fact, just to be safe and honest.
